Content Cardz Terms Of Use

K&L Advisors, Ltd. family of products and services (“Content Cardz”) provides a content marketing subscription service ("Content Cardz services") in connection to ContentCardz.com that allows our members to access and utilize website hosting software ("digital business cards"), educational training material ("member training library"), professional business coaching ("weekly content coaching"), and a technical support ("senior support team") provided over the Internet to Internet-connected computers, mobile phones, and other devices ("Content Cardz ready device").
 
You have accepted these Terms of Use, which govern your use of our service. Personally identifying information is subject to our Privacy Statement, the terms of which are incorporated herein. Please review our Privacy Statement to understand our practices.
 
As used in these Terms of Use, "Content Cardz service", "our service" or "the service" means the personalized service provided by K&L Advisors Ltd. for accessing and utilizing Content Cardz services, including all features and functionalities, recommendations and reviews, the website, coaching, support team, and user interfaces, as well as all content and software associated with our service.
 
This policies and procedures applies to all K&L Advisors Ltd. family of products and services sold on this site or any other site owned by K&L Advisors, Ltd. that includes a link to this page.
 

1. Membership
 
1.1. Your Content Cardz membership will continue and automatically renew until terminated. To use the Content Cardz service you must have Internet access and a Content Cardz ready device and provide us with one or more Payment Methods. "Payment Method" means a current, valid, accepted method of payment, as may be updated from time to time and which may include payment through your account with a third party. You must cancel your membership before it renews in order to avoid billing of the membership fees for the next billing cycle to your Payment Method (see "Cancellation" below).
 
1.2. We may offer a number of membership plans, including special promotional plans or memberships offered by third parties in conjunction with the provision of their own products and services. We are not responsible for the products and services provided by such third parties. Some membership plans may have differing conditions and limitations, which will be disclosed at your sign-up or in other communications made available to you. You can find specific details regarding your Content Cardz membership by visiting our website and clicking on the "Account" link.


2. Your Account

2.1 You agree to provide accurate and complete information when you register with, and as you use, Content Cardz, and you agree to update your account information to keep it accurate and complete. You agree that Content Cardz may store and use the information you provide for use in maintaining and billing fees to your Account.
 
 
3. Billing and Cancellation
 
3.1. Billing Cycle. The membership fee for the Content Cardz service any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged to your Payment Method on the specific billing date indicated on your "Account" page. The length of your billing cycle will depend on the type of subscription that you choose when you sign-up for the service. Membership fees are fully earned upon payment. In some cases your payment date may change, for example if your Payment Method has not successfully settled or if your paid membership began on a day not contained in a given month. 
 
3.2. Payment Methods. To use the Content Cardz service you must provide one or more Payment Methods. You authorize us to charge any Payment Method associated to your account in case your primary Payment Method is declined or no longer available to us for payment of your subscription fee. You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the service until we have successfully charged a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Check with your Payment Method service provider for details.
 
3.3 Updating your Payment Methods. You can update your Payment Methods by going to the "Account" page. We may also update your Payment Methods using information provided by the payment service providers. Following any update, you authorize us to continue to charge the applicable Payment Method(s).
 
3.4. Cancellation. You can cancel your Content Cardz membership at any time, and you will continue to have access to the Content Cardz service through the end of your billing period. To cancel, go to the "Account" page on our website and follow the instructions for cancellation. If you cancel your membership, your account will automatically close at the end of your current billing period. If you signed up for Content Cardz using your account with a third party as a Payment Method and wish to cancel your Content Cardz membership, you may need to do so through that third party, for example by visiting your account with the applicable third party and turning off auto-renew, or unsubscribing from the Content Cardz service through that third party. 
 
3.5. Changes to the Price and Subscription Plans. We reserve the right to change our subscription plans or adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion. Except as otherwise expressly provided for in these Terms of Use, any price changes or changes to your subscription plan will take effect following notice to you.
 
3.6. No Refunds. Payments are nonrefundable and there are no refunds or credits for partially used periods. Following any cancellation, however, you will continue to have access to the service through the end of your current billing period. At any time, and for any reason, we may provide a refund, discount, or other consideration to some or all of our members ("credits"). The amount and form of such credits, and the decision to provide them, are at our sole and absolute discretion. The provision of credits in one instance does not entitle you to credits in the future for similar instances, nor does it obligate us to provide credits in the future, under any circumstance.
 
4. Limitation of Liability

4.1 ALL CONTENT CARDZ CONTENT AND SOFTWARE ASSOCIATED THEREWITH, OR ANY OTHER FEATURES OR FUNCTIONALITIES ASSOCIATED WITH CONTENT CARDZ ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. CONTENT CARDZ DOES NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF CONTENT CARDZ WILL BE ERROR-FREE.

4.2 Content Cardz is not responsible for any problems or technical malfunction of any network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or redemption to be received by Content Cardz on account of technical problems or traffic congestion online or on the Internet or at any Web site, or any combination thereof including any injury or damage to customer’s or any other person’s computer related to or resulting from downloading or streaming any materials consistent with this agreement or subsequent use of any Content Cardz owned web properties. If, for any reason, Content Cardz service is not capable of running online as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Content Cardz which threatens or corrupts or adversely affects the administration, security, fairness, integrity or proper conduct, Content Cardz reserves the right, in its sole discretion, to cancel, terminate or suspend the account and/or any subscription. 

4.3 ANY ATTEMPT BY YOU TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF CONTENT CARDZ MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, CONTENT CARDZ WILL DISQUALIFY YOUR ATTEMPTED REDEMPTION AND RESERVES THE RIGHT TO SEEK DAMAGES FROM YOU TO THE FULLEST EXTENT PERMITTED BY LAW.

5. Social Media Groups and Communities

5.1 Business owners of all levels are welcome here. We have community members of all skill and experience levels, from college students to entrepreneurs to multi-million dollar enterprises.

5.2 We want people to feel safe when using our groups and forums. For that reason, we’ve developed a set of community guidelines, outlined below. These policies will help you understand what type of sharing is allowed in our private groups and communities, and what type of content may be reported to us and removed. Because of the diversity of our global community, please keep in mind that something that may be disagreeable or disturbing to you may not violate our community guidelines.

5.3 Keep it respectful. Comments that are inappropriately negative, rude, or attacking will be deleted, removed, or we will ask you to revise your thoughts. Everyone is here to learn and grow, so anything violating that will be removed.

5.4 No pitching to the group. We have a strict ‘no shopping for customers’ policy in our groups. This includes pointing people to blog posts with your offers/affiliate offers and publicly asking members to join your own Facebook groups or communities. Be cautious of unsolicited private messages to group members. If we get multiple complaints that you or someone else is using private messages to make unsolicited pitches to members, you may be asked to leave. You should view the group as your peers, not your leads.

5.5 No gated content. Content posted in the groups cannot be used to harvest leads in any way. If you need a feedback or a review, post the direct PDF, document, or screenshot. Don’t require people to opt-in to view.

5.6 Respect confidentiality. Content gathered in our online community groups cannot be collected, repackaged, and/or shared outside the group. Every member of our communities has a right to privacy and the right to feel safe that their questions, answers, and experiences remain privy to group members only.

5.7 Keep it on topic. We reserve the right to remove posts based on off-topic content or offensive content.

5.8 Partnering with other members. Access to this group does not mean that Content Cardz endorses anyone’s products or services. Please be cautious and do your due diligence when partnering with anyone in the group – don’t assume everyone is trustworthy. If you are looking for help implementing the stuff that Content Cardz teaches, ask Support.

5.9 Report posts that are breaking group policies. Due to the large amount of people in our groups and communities, it’s sometimes difficult for us to catch everything. If you see a post that is questionable, please report it, tag our community manager in the comments, or reach out to our community manger directly via private message so our team can review them.

5.10 Breaking the rules. Three warnings for rule-breaking behavior will result in a 7-day removal from the group. After the 7 day period, you are welcome to rejoin the group on a 30-day probation. If you break the rules again during your probation, you will be permanently removed from the community or group.

6. Intellectual Property

6.1 You agree that Content Cardz, including but not limited to Content Cardz Products and services, graphics, user interface, audio clips, video clips, editorial content, templates and the scripts and software used to implement Content Cardz Services, contains proprietary information and material that is owned by Content Cardz and/or its licensors, and is protected by applicable intellectual property and other laws, including but not limited to copyright. You agree that you will not use such proprietary information or materials in any way whatsoever except for use of the Content Cardz Services in compliance with this Agreement. No portion of the Content Cardz Services may be reproduced in any form or by any means, without expressed written permission from Content Cardz. You agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the Content Cardz Services in any manner, and you shall not exploit the Content Cardz brand in any unauthorized way whatsoever, including, but not limited to, by trespass or burdening network capacity.

6.2 Notwithstanding any other provision of this Agreement, Content Cardz and its licensors reserve the right to change, suspend, remove, or disable access to any Content Cardz products, content, or other materials comprising a part of the Content Cardz brand at any time without notice. In no event will Content Cardz be liable for making these changes. Content Cardz may also impose limits on the use of or access to certain features or portions of Content Cardz services, in any case and without notice or liability.

6.3 All copyrights in and to Content Cardz (including the compilation of content, postings, links to other Internet resources, and descriptions of those resources) and related software are owned by Content Cardz and/or its licensors, who reserve all their rights in law and equity. 

6.4 THE USE OF THE SOFTWARE OR ANY PART OF CONTENT CARDZ, EXCEPT FOR USE OF CONTENT CARDZ AS PERMITTED IN THIS AGREEMENT, IS STRICTLY PROHIBITED AND INFRINGES ON THE INTELLECTUAL PROPERTY RIGHTS OF OTHERS AND MAY SUBJECT YOU TO CIVIL AND CRIMINAL PENALTIES, INCLUDING POSSIBLE MONETARY DAMAGES, FOR COPYRIGHT INFRINGEMENT.

6.5 Content Cardz, the Content Cardz logo, other Content Cardz trademarks, service marks, graphics, and logos used in connection with Content Cardz are trademarks or registered trademarks of Content Cardz in the U.S. and/or other countries. Other trademarks, service marks, graphics, and logos used in connection with Content Cardz Services may be the trademarks of their respective owners. You are granted no right or license with respect to any of the aforesaid trademarks and any use of such trademarks.

7.1 Content Cardz office is open Monday – Friday 9a.m. -– 5p.m. EST
